Terms of Use, Safety, and Product Warranty

§1. General Provisions

  1. These regulations define the terms and conditions for making purchases in the Dragon Factory online store and establish the rules for the use, maintenance, safety, storage, and warranty of props produced and sold by Dragon Factory.
  2. Dragon Factory is an online store operated by the company “KM INTERNATIONAL Krystian Minda”, VAT number PL9482350920.

  4. All correspondence with the Seller, including but not limited to complaints, warranty claims, returns, and any other matters related to orders or products, shall be conducted exclusively in English. Communications submitted in any other language may be left unanswered or rejected.
  5. Purchasing a product constitutes acceptance of these terms and conditions.
  6. This regulation supplements the provisions of the Civil Code and the Consumer Rights Act.

§2. Product Characteristics

  1. Products are specialized props intended for artistic, stage or training purposes.
  2. Products are handmade, which may result in visual differences, assembly marks, and material inconsistencies. These features do not constitute a defect.
  3. Products may contain electronic components, 3D printed parts, and parts intended for pyrotechnic use.
  4. The available colors are shown in the photos included in the offers. The final color of the product may differ from the photos due to variations in supplier stock and production processes. Such differences do not constitute a product defect and are not a basis for complaint or return.
  5. If the product color is not specified at the time of purchase, the prop (or specific part) will be produced and delivered in black. Failure to select a color does not constitute grounds for a warranty claim or product return.
  6. Due to shipping limitations, the maximum selectable length is 150 cm. Orders exceeding this length cannot be fulfilled and will be adjusted to the maximum selectable length.
  7. 3D printed props may have visible print layers, minor surface imperfections, and color variations between batches. These features do not constitute a defect.
  8. The user is responsible for having knowledge of required permits, safety rules, and proper use of the product.

§3. Usage Rules

A. All Products

  1. The user is responsible for:
    1. using products according to their intended purpose,
    2. having knowledge of required permits, safety rules, and proper product use,
    3. regular inspection of the product's technical condition before each use,
    4. complying with applicable law.
  2. It is prohibited to use the props by persons under the influence of alcohol, drugs, intoxicants, or any substances that impair judgment, perception, or motor control, nor by persons lacking basic motor coordination.

B. Pyrotechnic Props

  1. Use of the props without the required permits, licenses, approvals, or mandatory notifications is strictly prohibited.
  2. The user is required to be fully familiar with and comply with all safety rules, regulations, and procedures applicable to stage pyrotechnics.
  3. The user is required to be familiar with and strictly follow all safety rules related to the use, charging, storage, and operation of electronic devices containing lithium-ion (Li-ion) batteries. Due to the presence of batteries, any contact with open fire or high-temperature sources is strictly prohibited. Exposure to heat may result in battery failure, fire, or explosion.
  4. The props are intended exclusively for cooperation with professional stage pyrotechnic systems equipped with electric ignition. They are not compatible with manual ignition, open flame, matches, lighters, or any improvised or non-certified ignition systems.
  5. Props may be used solely by adults who are properly trained in pyrotechnic safety and emergency procedures.
  6. Indoor use of the props is strictly prohibited.
  7. It is prohibited to use the props if any objects, trees, flammable materials, combustible surfaces, or other potentially ignitable items are located within a minimum radius of 10 meters from the point of use.
  8. It is prohibited to wear clothing, accessories, footwear, or materials that are flammable, combustible, or prone to melting when exposed to heat, sparks, or open flame.
  9. The use of protective safety goggles is recommended when handling pyrotechnic materials.
  10. It is prohibited to strike the props against hard surfaces, crush, bend, twist, overload the structure, or expose the props to fire, high temperatures, liquids, moisture, or other damaging conditions.
  11. It is prohibited to use the props during rain, snow, or in conditions of high humidity.
  12. All use of the props is performed entirely at the user's own risk and responsibility.
  13. Before using pyrotechnic devices, it is recommended to fully charge the battery.
  14. The props may be used only within an ambient temperature range of 0°C to +35°C.
  15. Props may only be stored within a temperature range of +15°C to +30°C, in a dry and safe environment, protected from pressure, impact, and UV radiation.
  16. Leaving the product in a discharged state may permanently damage the battery and prevent recharging. Deep discharge is not covered by warranty.
  17. Opening, disassembling, modifying, repairing, or using the props in a manner inconsistent with their intended purpose is strictly prohibited.
  18. The props are not covered by warranty or subject to claims in cases of mechanical damage or damage resulting from fire, water, moisture, high temperature, pyrotechnic materials, improper use, or failure to comply with safety rules.

C. LED Props

  1. The user is required to be familiar with and strictly follow all safety rules related to the use, charging, storage, and operation of electronic devices containing lithium-ion (Li-ion) batteries. Due to the presence of batteries, any contact with open fire or high-temperature sources is strictly prohibited. Exposure to heat may result in battery failure, fire, or explosion.
  2. It is strictly prohibited to strike props against hard surfaces, crush, bend, twist, overload, or otherwise deform their structure. Props must not be exposed to fire, high temperatures, liquids, moisture, or other damaging conditions.
  3. It is prohibited to use the props during rain, snow, or in conditions of high humidity.
  4. Props may only be used within an ambient temperature range of 0°C to +35°C.
  5. Props may only be stored within a temperature range of +15°C to +30°C, in a dry and safe environment, protected from pressure, impact, and UV radiation.
  6. Leaving the product in a discharged state may permanently damage the battery and prevent recharging. Deep discharge is not covered by warranty.
  7. It is prohibited to leave the device powered off exclusively via remote control, as this may lead to battery discharge. The device must be fully powered off using the physical power button.
  8. Opening, disassembling, modifying, repairing, or using props in a manner inconsistent with their intended purpose is strictly prohibited.
  9. Props are not covered by warranty, nor are claims accepted, in cases of mechanical damage or damage caused by fire, water, high temperatures, pyrotechnic materials, improper use, or failure to comply with safety rules.

D. Fireshow Props

  1. The user is required to be fully familiar with and follow all safety rules related to handling and working with fire.
  2. Use of props without the required permits, authorizations, or notifications is strictly prohibited.
  3. Props are intended exclusively for use with professional fuels designed for fireshow performances and must be handled only by trained adults.
  4. Use of props is entirely at the user's own risk. The Seller is not responsible for any accidents, injuries, damage, or consequences resulting from the use of props.
  5. It is prohibited to use the props if any objects, trees, flammable materials, combustible surfaces, or other potentially ignitable items are located within a minimum radius of 10 meters from the point of use.
  6. It is prohibited to wear clothing, accessories, footwear, or materials that are flammable, combustible, or prone to melting when exposed to heat, sparks, or open flame.
  7. Indoor use of props is strictly prohibited. Props must only be used outdoors in safe, open areas.
  8. It is prohibited to strike props against hard surfaces, crush, bend, twist, overload, or otherwise deform the structure.
  9. The use of protective safety goggles is recommended when handling charcoal materials.
  10. It is prohibited to leave props unattended or not fully extinguished, including leaving burning or smoldering elements to extinguish on their own. The wick must be properly and actively extinguished immediately after use using appropriate fire-safety methods, as uncontrolled self-extinguishing leads to overheating, accelerated material degradation, structural damage to the wick and mounting elements, and significantly shortens the product's lifespan.
  11. Mechanical damage or failures resulting from improper use, mishandling, or noncompliance with these safety rules are not covered by warranty and do not constitute grounds for claims.

E. 3D Printed Props

  1. Props are sensitive to high temperatures and exposure to ultraviolet (UV) radiation. Prolonged exposure may cause deformation, discoloration, or reduced durability.
  2. It is strictly prohibited to expose props to open flames, high temperatures, excessive heat sources, or mechanical overload. This includes striking, crushing, bending, twisting, or overloading the props beyond their intended use.
  3. Props are not covered by warranty and claims will not be accepted for any damage resulting from mechanical stress, fire, high temperature, pyrotechnic materials, or other improper use.

§4. Power Supply and Batteries

  1. LED and pyrotechnic props are powered by lithium-ion (Li-ion) batteries.
  2. The user must be familiar with the principles of working with Li-ion batteries.
  3. Charging is only allowed at temperatures between 10°C and 30°C.
  4. Only recommended chargers (DC 5.5/2.1, 4.2V, 1A) for Li-ion batteries should be used. Use of non-original or incompatible chargers is strictly prohibited.
  5. It is prohibited to charge outside the allowed temperature range, overcharge, fully discharge, or leave the product charging unattended.
  6. Natural battery wear (capacity reduction over time) is not a defect.
  7. Battery damage caused by improper use is not the responsibility of the Seller.
  8. Replacing, dismantling, or modifying Li-ion batteries may result in product damage, fire, or electric shock and is not subject to warranty claims.

§5. Maintenance and Storage

  1. Props should be stored in a dry, well-ventilated place, at room temperature, protected from mechanical pressure, impacts, crushing, deformation, and direct UV radiation. Props must not be stored near heat sources, open flames, flammable materials, or in environments with high humidity, condensation, or extreme temperatures. Improper storage may result in permanent damage and excludes the Seller's liability.
  2. Cleaning is permitted only using a dry or slightly damp, soft cloth. The use of chemical agents, solvents, alcohols, detergents, abrasive materials, compressed air, or high-pressure cleaning methods is strictly prohibited, as it may cause damage to electronic components, surface finishes, or structural elements.
  3. Props must be stored and handled in accordance with the safety rules and limitations of the materials from which they are made, including electronic components, Li-ion batteries, 3D-printed parts, and elements intended for fire or pyrotechnic use. Failure to comply with material-specific safety requirements may result in damage, loss of functionality, or safety hazards and excludes the Seller's responsibility.

§6. Safety

  1. The user bears full responsibility for how, where, and under what conditions the props are used. This includes full compliance with all applicable laws, regulations, and safety standards relevant to the specific type of prop.
  2. All props, including pyrotechnic, fireshow, LED, and 3D-printed items, may be used exclusively by trained adults who are familiar with proper operation, safety procedures, and emergency protocols. The Seller is not responsible for accidents, fires, burns, injuries, or other harm resulting from the use of the props.
  3. The user is obligated to ensure a safe environment during use, including but not limited to:
    1. maintaining a safe distance from flammable materials, combustible surfaces, spectators, animals, vehicles, and any objects that could be damaged,
    2. avoiding use in confined or poorly ventilated spaces, near heat sources, or during adverse or extreme weather conditions,
    3. refraining from using props under the influence of alcohol, drugs, or any substances that impair judgment, perception, or motor control.
  4. LED props may emit intense or flashing light. They must not be pointed directly into the eyes at close range, and prolonged exposure should be avoided to prevent discomfort or potential eye injury.
  5. Pyrotechnic and fireshow props require additional safety measures. They may be used only in accordance with applicable laws and safety regulations, with appropriate fire-extinguishing equipment and protective gear available at all times.
  6. Handling of the props by untrained or unauthorized persons is strictly prohibited.
  7. All props are used entirely at the user's own risk. The user assumes full responsibility for any consequences resulting from use, including accidental damage, injury, or harm to persons or property.
  8. The user is solely responsible for obtaining and maintaining any permits, licenses, approvals, or insurance required for the lawful and safe use of the props.
  9. Before each use, the user must perform a thorough inspection of the technical condition of the props, including mechanical integrity, electrical functionality, and any signs of wear, damage, or malfunction.
  10. Any unauthorized modification, disassembly, repair, or alteration of the props may result in malfunction, fire, electric shock, or personal injury and automatically voids any warranty or right to submit claims.
  11. The user must observe all safety rules applicable to the props, including temperature limits, proper handling practices, and correct storage conditions, to ensure safe operation.
  12. The Seller shall not be liable for any injuries, material damage, losses, or harm to third parties resulting from improper, negligent, or unauthorized use of the products. This includes, without limitation, incidents occurring during storage, transport, preparation, performances, demonstrations, or handling of the props. The Seller bears no responsibility for any damage, loss, injury, or consequences arising from the Buyer's or user's actions or omissions, including improper handling, incorrect storage, transport, installation, modification, maintenance, or use of the product. This exclusion of liability applies to property damage, personal injury, bodily harm, fire, accidents, legal consequences, and any harm caused to third parties. Full responsibility for all such outcomes rests solely with the Buyer or user of the product.

§7. Claims

  1. The warranty period is 1 year from the date of purchase.
  2. Claims must be reported immediately after detecting a defect.
  3. Complaints should be submitted by email to:
  4. The report should include the order number, a description of the problem, photos and video documenting the defect.
  5. The complaint will be investigated within 14 days of receipt and the customer will be informed via email of the next steps (repair, replacement, price reduction, partial refund).
  6. Claims do not cover:
    1. Mechanical damage - any breaks, cracks, deformations, dents, or chips resulting from drops, impacts, crushing, bending, twisting, or excessive mechanical overload.
    2. Broken electronic parts - any damage to wires, plugs, connectors, or other electrical components caused by improper handling, dropping, bending, or misuse of the prop.
    3. Discharged batteries - permanent damage caused by deep discharge, overcharging, or improper use. Natural battery wear over time is also not covered.
    4. Liquid damage - damage caused by contact with liquids, moisture, rain, snow, or other fluids.
    5. Burns and melting - color changes, discoloration, material deformation, or melting caused by fire, high temperature, or hot surfaces.
    6. Discoloration or material structure changes.
    7. Impact marks - dents, deformations, or other damage caused by impacts with hard surfaces or external objects.
    8. Damage from detonation, ignition, pyrotechnic use, or improper use.
    9. Damage during transport - any damage occurring while the product is in transit, including shipping, delivery, or transport by the Client.
    10. Damage caused by improper use - any damage resulting from misuse, careless handling, ignoring safety instructions, exposure to prohibited conditions, or unauthorized modifications.
    11. Damage caused during opening or unpacking of the shipment, including damage resulting from the use of knives, blades, scissors, or other tools.
  7. The Seller is not responsible for any components that are lost, misplaced, or removed by the user, including but not limited to chargers, remotes, screws, batteries, or other accessories provided with the product. Loss or damage of these components by the user does not constitute grounds for warranty claims, returns, or complaints.
  8. Claims may be rejected if proper photo/video documentation is not provided; the product shows signs of user interference, modifications, or repairs; if it was used inconsistently with the instructions, safety rules, or its intended purpose; if mechanical damage occurred; or if the product was used or stored outside the permitted temperature ranges. Claims may also be denied if improper charging, exposure to liquids, fire, high temperatures, or other prohibited conditions contributed to the damage.
  9. The Client is responsible for all costs associated with returning the props. This includes shipping fees, packaging, and any other expenses incurred during the return process. The Seller is not responsible for damage or loss that occurs during return shipping.
  10. The Seller reserves the right to repair the product, replace a part, or refuse the claim.

§8. Returns

  1. The Client has the right to return the product within 14 days from the date of receipt. This period begins on the day the Client physically receives the product.
  2. Returns are accepted only if the product meets all of the following conditions:
    1. It is in perfect, undamaged condition;
    2. It has not been used or operated in any way inconsistent with its intended purpose;
    3. All original components, accessories, packaging, manuals, and protective materials are complete and included;
    4. The product is properly secured and packaged for safe transport back to the Seller.
  3. Products that show any signs of use, interference, modification, damage, or neglect, including but not limited to scratches, dents, missing parts, or alterations, are not eligible for return and will not be accepted.
  4. Products individually customized or personalized, including but not limited to color, length, design modifications, or other custom specifications, are not eligible for return. Once a custom order has been placed and confirmed, the Client cannot cancel, modify, or change the order for any reason.
  5. The Client is fully responsible for all costs associated with returning the product, including shipping, packaging, and any handling fees. The Seller is not responsible for any loss, damage, delay, or additional costs incurred during the return process.
  6. Damage to the product occurring during the return shipment, including damages caused by insufficient packaging, mishandling by transport companies, or other factors under the Client's control, is the responsibility of the Client and is not covered by warranty or claims.
  7. Returns must be accompanied by all required documentation, including a copy of the purchase invoice or receipt, and any forms requested by the Seller. Returns without proper documentation may be rejected.
  8. The Seller reserves the right to inspect the returned product upon receipt. Only products meeting all return conditions will be accepted, and any discrepancies may result in partial or complete rejection of the return.

§9. Shipping and Delivery

  1. All orders are prepared and shipped via external courier companies chosen by the Seller. Once the shipment is handed over to the courier, the Seller no longer has direct control over its handling, transit, or delivery.
  2. The Client is responsible for contacting the courier company directly for any inquiries regarding shipment status, location, or delivery issues, from the moment the shipment leaves the Seller's premises.
  3. Orders are processed and shipped only after full payment is received. Partial payments, pending payments, or unpaid orders will not be dispatched.
  4. Delivery times provided by the Seller or courier are estimated and may vary due to factors outside the Seller's control, including weather, customs clearance, courier schedules, or logistical delays. The Seller does not guarantee delivery by a specific date or time.
  5. The Seller is not responsible for any damage, delay, loss, or other incidents that occur during transport, including but not limited to:
    1. Damage caused by handling by the courier, loading/unloading, or transport conditions.
    2. Customs inspections, fees, or delays.
    3. Loss or misplacement during transit.
    4. Theft or damage due to third parties.
  6. The courier company is responsible for the shipment once it has been accepted into their system.
  7. If the Customer refuses to accept delivery or fails to collect the shipment within the courier's deadlines, the costs of the order and shipping are non-refundable. The Customer bears full responsibility for any resulting loss or additional charges.
  8. The Customer is obliged to inspect the package immediately upon delivery, before signing for it if possible. Any damage, missing items, or other discrepancies must be documented and reported within 14 days of receipt.
  9. To submit a claim related to damage or loss during shipping, the Customer must provide:
    1. Clear photos/video of the package, including external and internal packaging, immediately after receipt.
    2. Continuous video recording of the entire unboxing process from the moment of receipt until the props are completely removed from the packaging.
    3. A formal damage report completed with the courier at the time of delivery or immediately afterward, according to the courier's procedure.
  10. If the Customer returns a shipment for reasons other than a proven fault of the Seller (e.g., change of mind, refusal to accept delivery, incorrect address), all shipping, handling, and return costs are the Customer's responsibility.
  11. The Seller is not responsible for any damage caused, including while transporting the props between events, using public transport, storing in vehicles, carrying by hand, or otherwise moving the products. Such damages are the full responsibility of the Customer.
  12. Any missing or lost items during the Customer's handling or transport are not covered by the Seller.

§10. Prices, Taxes, and Customs Duties

  1. Product prices are indicated in the currency shown in the offer. For gross prices, VAT is included according to applicable law. For net prices, VAT must be added according to the local rates in the country of sale.
  2. Within the European Union VAT will be charged according to EU and national law. VAT compliance is the Seller's responsibility for consumer sales.
  3. For orders outside the EU, the Client may incur additional costs, including customs duties, import taxes, and other local fees required by the destination country.
  4. The Seller is not responsible for any fees imposed by the destination country. All obligations regarding determination, declaration, and payment of such costs lie solely with the Client. The Client pays these fees at their own expense and cannot charge the Seller.
  5. Customs duties and import taxes depend on the laws of the destination country and may vary depending on the shipment value, product type, and local regulations. Failure to pay required fees may result in shipment retention by customs or return to the Seller at the Client's expense.

§11. Personal Data Protection

  1. The controller of customers' personal data is Dragon Factory. Personal data is collected and processed solely for the purpose of order processing, fulfillment, delivery, and any legally required accounting or documentation. Customers' personal data is not used for marketing, advertising, profiling, newsletters, or any other purposes unrelated to the execution of the order, and is not shared with third parties except where necessary to complete the order or where required by applicable law.
  2. Customers have the right to access, rectify, restrict processing, and request deletion of their personal data, as well as other rights provided under applicable data protection laws.

§12. Final Provisions

  1. The regulation may be updated by the Seller.
  2. Matters not regulated by this regulation are governed by Polish law.
